Defense of Flávio Bolsonaro requests removal of Moraes

The defense of Senator Flávio Bolsonaro (PL-RJ) submitted to Supremo Tribunal Federal (STF) a request for Minister Alexandre de Moraes to be removed from the investigation that purges alleged money laundering involving the parliamentary and lawyer Willer Tomaz. The lawyers argue that Moraes should have left the case because he would have used an aircraft linked to the business structure investigated by the Federal Police. The plane also appears in the report on the relationship between Flavio and Willer, who are investigated for suspected money laundering.

If the STF does not recognize the impediment, the lawyers ask that the minister’s suspicion be declared. The petition was filed this week and has no date for trial. The case proceeds in secrecy, but the defense has disclosed the main arguments.

Use of jet and corporate bonds

The defense claims that Moraes and Moraes’ Viviane Barci used the Legacy 650 jet, with the prefix PP-NLR, in July and August 2025. The aircraft belongs to Fraction 024 Administração de Bem Próprio S.A., a company that also appears in the investigation on Flávio and Willer. According to the petition, the company was divided between Willer Tomaz, Laércio Cosentino, founder of TOTVS, and Prime You. The lawyer was reportedly one of the partners, while Daniel Vorcaro, owner of the Banco Master, held a stake in Prime You from 2021 to September 2025.

The defense also mentions that Viviane was hired by Banco Master for R$ 130 million and states that the Federal Police is investigating the possible transfer of Fraction 024 shares as part of the payment to the office. The office denies this business relationship. Flávio’s lawyers maintain that these links make it necessary to remove Moraes from the conduct of the case. In the petition, they state that the result of the survey on the society can have repercussions in the legal sphere of the minister's wife and in facts in which he himself participated as a passenger.

Request for revocation of precautionary measures

In addition to the change of rapporteur, the defense requests the repeal of the precautionary measures determined against Flávio. Among them are the cancellation of Brazilian passports, the delivery of the Italian document and the prohibition of contact with Willer Tomaz. The lawyers dispute the grounds used to justify the restrictions. They claim the bank denied that Flávio was a “master user” of Willer-related accounts and argue that the risk of leakage could not be grounded in third-party statements.

The defense also argues that questioning the electoral result by institutional means could not be considered an indication of intention to leave the country. The petition does not mention Flavio’s trip to the Estados Unidos, which took place after the determination of the delivery of the passports. The lawyers ask that the measures be repealed immediately, considering that there is no more justification for maintaining them.

Report of André Mendonça

On another front, the lawyers argue that the case should be under the report of André Mendonça, responsible for the investigation of fraud at INSS, known as Operation Without Discount. The defense states that the investigation involving Flavio would be a development of this investigation and that the two cases have as a common point the investigation on Willer Tomaz and his network of companies. Therefore, they argue that prevention should be recognized and the process redistributed.

The investigation investigates whether Flavio and Willer maintained an indirect money laundering company, including through a bookmaker. Both deny irregularities. The senator claims that he never had a partnership with Willer and that all his activities were lawful. Willer Tomaz also denies any involvement in illegal schemes.

Next steps

The request will be analyzed by Minister Alexandre de Moraes himself, who can decide monocratically or lead to the plenary of the STF. There is no time limit for decision. The defense expects the court to recognize the impediment or suspicion and, consequently, to annul the injunction. In the meantime, the investigation is still ongoing in the Federal Police, under secrecy.

The case gains national repercussions by involving a senator of the Republic and a minister of STF. The decision on removal may influence other processes in which Moraes acts as rapporteur, especially those related to political investigations. The defense of Flávio Bolsonaro states that it will continue to seek all legal means to ensure the fairness of the trial.
